These Terms of Service and Privacy Policy apply to services provided by Midnight Byte, LLC, a Maryland, USA company, and to this website. Our services include computer and smart-device repair, networking, training, upgrades, virus removal, data recovery, web design and hosting, and services involving connected online accounts.

Midnight Byte generally favors customer privacy. We aim to limit access to and handling of customer information to what is reasonably practical to provide the requested service cost-effectively, support our work, comply with legal obligations, or work with third-party services. Cost-effective practices can also benefit customers. Midnight Byte does not collect customer data for the purpose of reselling it.

Terms of Service

Service authorization

When you request a service, you authorize Midnight Byte to access the devices, systems, accounts, and information reasonably needed to perform that service. You are responsible for having authority to provide that access and for obtaining permission from any other person whose accounts, devices, or information are involved.

Your data and backups

You are responsible for maintaining your own current copies of important files and data. Midnight Byte may make a backup when you request one or when we consider it appropriate to make a service request safer. A backup may be made without separate notice. Backups are not guaranteed, may not include all data, and are not a guarantee against loss. Do not rely on a Midnight Byte backup as your only copy.

Backups are deleted when no longer needed for the project or service, upon request, or as part of periodic cleanup. You may ask us to delete a backup using the contact form; requests are subject to the retention and legal needs described in the Privacy Policy.

Service limitations

Diagnosis, repair, data recovery, networking, hosting, and other technical services can involve risk. Devices may fail, data may be damaged or unavailable, and outcomes cannot always be predicted or guaranteed. Services may also depend on networks, software, hosting infrastructure, manufacturers, and other third parties that Midnight Byte does not control. Specific written service agreements may set additional terms for particular work.

Third-party platforms and connected accounts

Some services use third-party platforms or software, including tools for publishing or managing customer-approved social-media accounts. Integrations receive only the information and permissions approved by the customer through the relevant platform. You can revoke an app’s access using the access controls in your own social-media account. Revoking access may affect the service and does not necessarily delete information already held by the platform or provider.

Scope of these terms

These are general service terms, not a complete agreement for every project. A separate written agreement may contain additional or different terms for the service it covers. Nothing in this page promises a particular repair, recovery, hosting, or third-party platform outcome.

Privacy Policy

Information we receive

Most customer information is provided directly by customers, for example when they contact us, request service, provide access to an account or device, or share information needed for a project. While providing services, we may encounter information stored on a device, in an account, or in customer systems. Website and service providers may also process technical, usage, or verification information when their tools are used.

How we use information

We use information to respond to inquiries, provide and support requested services, troubleshoot issues, maintain records for accountability, and meet legal or operational needs. We do not collect customer data for the purpose of reselling it. We aim to access and handle only what is reasonably practical for the service and the purposes described here.

Emails, messages, and call recordings

We retain emails, messages, and call recordings indefinitely to assist with future troubleshooting, maintain accountability, and address legal matters. When you call Midnight Byte, you hear a notice that the call may be recorded. If we call you in response to an email or message you sent, you may not hear a recording notice before recording begins.

Backups and retention

We may back up customer data at your request or when we consider it appropriate to make a service request safer. We may not notify you each time we make a backup. We delete backups when they are no longer needed for a project or service, when you request deletion, or when we identify them during periodic review as stale or no longer needed. Backups are not guaranteed; you remain responsible for keeping your own copies of your data.

Other information is kept for as long as reasonably needed for the service, the purposes described in this policy, or legal and operational requirements. You may contact us to request deletion of information or a backup. We consider requests case by case, including whether information is needed for an active service, future troubleshooting, accountability, or legal recordkeeping. This means we may not be able to delete every record on request.

Third-party providers and services

We may use third-party services to operate the website, prevent abuse, provide communications, support customer-approved account integrations, host or deliver services, or assist with work, including through AI tools. When used, these providers may process information needed for their role. Providers, services, and their data practices can change over time and without notice. Their handling of information is governed by their own terms and privacy practices; we do not promise that every provider has the same retention or data-use practices.

We do not maintain a fixed list of every provider because the tools used can change. If you have a concern about a particular service or information needed for your project, contact us before sharing it or before the work proceeds.

Disclosure and security

We may disclose information when required by law or when reasonably necessary to protect rights, safety, systems, or property. We use practical safeguards appropriate to our services, but no method of storage, transmission, backup, or online service can be guaranteed completely secure.

Changes and contact

We may update this page as our services, operational needs, or third-party providers change. The current version will be posted here. For questions, privacy requests, or backup-deletion requests, contact Midnight Byte.
